[1] Terms of service:
By using Hostshield LTD products and services, you agree to accept our Terms & conditions. Any complaints from the Client’s side regarding service suspension or termination will not be considered. Bulk Mailing, spamming, Email marketing services are not provided by Hostshield LTD. These actions can put our company and Client’s in risky conditions Hostshield LTD provides hosting services to clients from all over the world, and we consider it as a responsibility to protect each Client and to provide the best services without any interruption. All registered Clients are subject to the following terms of service:
[2] Indemnification Policy:
You agree to use all HOSTSHIELD LTD services at your own risk. HOSTSHIELD LTD specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall HOSTSHIELD LTD be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold HOSTSHIELD LTD harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against HOSTSHIELD LTD , its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless HOSTSHIELD LTD against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with HOSTSHIELD LTD ‘s server. HOSTSHIELD LTD reserves the right to intervene with any of the sites and/or contents hosted on its servers in the interest of its customers and/or third parties. Any material supplied by customers infringing or allegedly infringing on the proprietary rights of a third party will be not tolerated. HOSTSHIELD LTD reserves the full and complete right to take any action, including suspending or disabling the account and/or space granted under the contract with the customer, in the event of such violations or potential violations, even upon simple notification by third parties.
[3] Acceptable Use Policy
All services provided by HOSTSHIELD LTD may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of the laws of United Kingdom or Netherlands is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless HOSTSHIELD LTD and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all HOSTSHIELD LTD servers. This includes sites that include sexually explicit or hardcore images and/or advertising.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company
Subscriber further acknowledges that the company’s liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury. Illegality in any form, such as the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or the distribution or possession of obscene material is forbidden and will result in the termination of your account even without prior notice. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
[4] LIMITATION OF LIABILITY
HOSTSHIELD LTD shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from HOSTSHIELD LTD servers going off-line or being unavailable for any reason whatsoever. Furthermore, HOSTSHIELD LTD shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of HOSTSHIELD LTD servers. All damages shall be limited to the immediate termination of service.
DISCLAIMER
HOSTSHIELD LTD cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by HOSTSHIELD LTD are resold. Thus, certain equipment, routing, software, and programming used by HOSTSHIELD LTD are not directly owned or written by HOSTSHIELD LTD . Moreover, HOSTSHIELD LTD holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as HOSTSHIELD LTD sees fit. FURTHERMORE, HOSTSHIELD LTD retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
[5] Refund Policy
We provide a 48 hours money back guarantee. The refund process will take from 5 to 7 business days. Services Refund Policies has been explained elaborately in each category of the Hostshield LTD Services Terms and Conditions. Hostshield LTD has the right to accept or deny any refund or credit request.
Refunds for any service which have Abuse Reports are not accepted.
Note:
Crypto payments are non refundable but may receive account credits. The minimum amount for withdrawal of Hostshield LTD Credit Balance is $20. Any refund request for lower amounts will be deposited into Client’s Credit Balance.
[6] Hostshield LTD Services Terms and Conditions:
Hostshield LTD provides the following services:
- Virtual Private Servers (Windows VPS & Linux VPS)
- Dedicated Servers
- Shared Hosting
- Domain Names
[6.1] Virtual Private Servers:
Hostshield LTD Virtual Private Servers are delivered within 30 mins after the payment is received. The details of the VPS will be sent to the Client’s registered email. Any breach of our Terms and Conditions will cause the suspension of the VPS. The suspension reason is sent to the Client’s email address stating the reason of the suspension along with the abuse report. The deadline for renewal of the VPS services is just considered to be 4 days from the due date. After 4 days has passed from the due date, the service will be terminated and the data on the server will be non retrievable.
Backups and Loss:
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. Hostshield LTD is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Hostshield LTD servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by Hostshield LTD.
Renewal:
The renewal process of our VPS services is done automatically. The renewal invoice is sent to the Client’s email address 15 days prior the due date. On the due date, the service will be suspended due to unpaid invoice and a suspension email will be sent to the Client’s email address. Your VPS will remain suspended for 5 days and after this time your VPS will be terminated.
Refund:
Each refund request is evaluated case by case, if a refund is not issued, your account may be credited with the requested amount. Regarding Service technical issues, in the absence of the solution from Hostshield LTD , refund requests of the Clients within 48 hours of the service delivery time will be acceptable.
[6.2] Dedicated Servers:
Hostshield LTD Dedicated Servers are delivered within 24 to 48 hours(business days) after the payment is received. The details of the Dedicated Server will be sent to the Client’s registered email. Any breach of our Terms and Conditions will cause the suspension of the Dedicated Server. The suspension reason is sent to the Client’s email address stating the reason of the suspension along with the abuse report.
Backups and Loss:
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. Hostshield LTD is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Hostshield LTD servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by Hostshield LTD.
Renewal:
The renewal invoice is sent to the Client’s email address 15 days prior the due date. Any procrastination from Client regarding overdue on the payment will result in the suspension of the server. The deadlineof the renewal of Dedicated Servers is 24 hours before due date of service, after this the server will be terminated permanently and any requests for data-recovery shall be rejected.
Refund:
Each refund request is evaluated case by case, if a refund is not issued, your account may be credited with the requested amount. Regarding Service technical issues, in the absence of the solution from Hostshield LTD , refund requests of the Clients within 48 hours of the service delivery time will be acceptable.
[6.3] Shared Hosting:
Hostshield LTD Shared hosting service will be delivered within 10 minutes after the payment is received. The details of the Shared hosting account will be sent to the Client’s registered email. According to our abuse terms, any infringement, phishing, pharming, Violation, Mining and other illegal using of the Shard Web Hosting service must result in suspension of the service without any procrastination and postponing. The suspension reason is sent to the Client’s email address but Hostshield LTD has the right to suspend the service without any notification send to the client’s email address.
Backups and Loss:
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. Hostshield LTD is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Hostshield LTD servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by Hostshield LTD.
Renewal:
The renewal process of our shared hosting services is done automatically. The renewal invoice is sent to the Client’s email address 15 days prior the due date. On the due date, the service will be suspended due to unpaid invoice and a suspension email will be sent to the Client’s email address. Your shared hosting service will remain suspended for 5 days and after this time your shared hosting account will be terminated.
Refund:
Each refund request is evaluated case by case, if a refund is not issued, your account may be credited with the requested amount. Regarding Service technical issues, in the absence of the solution from Hostshield LTD , refund requests of the Clients within 48 hours of the service delivery time will be acceptable.
[6.4] Domain Names:
Domain Names are activated within 12 hours(business days) after the payment is received. The activation details will be sent to the Client’s registered email. Any infringement, Violations , Surreptitious domain names will be suspended According to the Registrar Terms and conditions and Refund requests regarding activation of the domain will be rejected.
Refund:
Each refund request is evaluated case by case, if a refund is not issued, your account may be credited with the requested amount.
[7] Hostshield LTD Service Abuse Terms:
Virtual Private Servers:
Phishing/Pharming:
This type of report is at high priority for suspension of the service, any request for reactivation of the service is subject to our abuse department. As soon as the report received, the service will be suspended and an email for suspension reason will be sent to the Client’s Email address.
Attacking:
Any abuse report regarding Server attacking will be reviewed by our abuse department and the service must be suspended swiftly.
Bots:
These types of Abuse Reports will result in suspension of the service without any procrastination. Any requests about reactivation of service will be rejected.
Spamming and illegal Copyright :
This type of Abuse Reports is considered to be reviewed by our abuse department. In case the issue resolved by Clients, the service can be reactivated by some conditions but this is not possible for all of the Spamming and illegal Copyright Abuse Reports.
Abuse Reports of Dedicated Servers:
Abuse Reports of these services at the first stage will be reviewed by our abuse department and a Warning Ticket will be sent for Clients. For the second time, if we receive the Abuse Report of Dedicated Servers, in this case, the service will be suspended without any reactivation process to be done
Abuse Reports of Shared Hosting:
Shared hosting Abuse Reports are categorized into two groups :
- Domains
- Dedicated IPs
Domains:
Any Phishing Report with regard to the Add-on, or Parked domains and Subdomains consequently results in suspension of the service and requests appertaining reactivation of the service will be rejected.
Dedicated IPs:
Any types of Abuse Reports for Web Hosting IPs will result in suspension of the service without reactivation process to be achieved.
